General Terms and Conditions – Green Spirit Shop
 

1. Acceptance of conditions

These general conditions of sale govern the contractual relationship between you and TRI S.A. Green Spirit Hotels, both parties accepting them without reservation. These general terms and conditions of sale will prevail over any other conditions contained in any other document, except prior, express and written derogation.

You acknowledge that you have taken note of them at the time of placing your order and declare expressly accept them without reservation. The validation of your order therefore constitutes acceptance of these general conditions of sale.

 

2. Products

The photographs illustrating the products do not enter the contractual field. Should errors occur, TRI S.A. Green Spirit Hotels cannot be held liable.

 

3. Order

Automatic registration systems shall be deemed to be proof of the nature, content and date of the order.
TRI S.A. Green Spirit Hotels confirms acceptance of your order at the e-mail address you have provided. The sale will only be concluded after confirmation of your order and receipt of the full payment.

TRI S.A. Green Spirit Hotels reserves the right to refuse or cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.

The information stated by the purchaser, when taking an order, commits the customer: in the event of an error in the addressee's address, the seller cannot be held responsible for the impossibility of delivering the product.

 

4. Delivery

Delivery is by post or carrier according to the country of destination, and according to the choice expressed by the customer. In case of apparent defects, you have a right of return under the conditions provided for in article 6.

Are considered as force majeure unloading the seller from his obligation to deliver, war, riot, fire, strikes, accidents and the impossibility of being supplied in case of stock shortage.

Goods always travel at the recipient's own risk. Always check your package on arrival. You have a deadline of 3 days for a delivery in France and Luxembourg and 7 days for a delivery in Europe, to make any complaints with the carrier in case of missing or degradation.
 

5. Transportation

5.1 The shipping cost is calculated at the real price, without any margin in favour of TRI S.A. Green Spirit Hotels. All shipments abroad are carried out by carrier, parcel post or registered mail. TRI S.A. Green Spirit Hotels is in charge of  the cost of packing and handling, they are offered to you.

 

5.2 For national destinations, the proposed routing is Colissimo delivery with insurance. For international destinations, only the Colissimo route with insurance for the European countries is proposed to you. For other destinations, please contact us to give you specific rates and deadlines.

 

5.2 bis Delivery by another carrier (UPS, TNT, etc.) is possible but is not currently provided in the interface. You can contact us for a personalized quote in case of delivery by carrier.

 

5.3 The price of the transport is calculated according to the weight of your order. It will appear when you select the delivery method on your order form.

 

5.4 Delivery time for transport

The delivery times announced are those of the Post Office, namely, in France, 2 days for Colissimo, 2 to 4 days for the letter rate for books, CDs and DVDs. Weekends and holidays must be added to the transport times.


 

6. Product Compliance

6.1 We undertake to reimburse you or to exchange the defective or damaged products that do not correspond to your order (excluding damage due to transport). In this case, we would be grateful if you could give us a detailed description in writing and send us the product(s) concerned. TRI S.A. Green Spirit Hotels will, at your option, exchange or refund the product(s) and refund the cost of return transportation. The request must be made within fifteen working days following delivery to the address below. Any complaint made outside this period cannot be accepted.

7. Retraction & Return

In accordance with the European Community regulations applicable to distance selling, you have 7 days from receipt of the items to return us the product which would not suit you.

In case of exchange or refund, the article must be returned new, in its original packaging, intact, accompanied by any accessories, instructions and documentation to the following address:

The right of return does not apply to books, CDs and DVDs.

Upon exercise of the right of return, TRI S.A. Green Spirit Hotels will refund the amounts paid to you, free of charge, with the exception of postage costs. The refund will be made within a maximum of 15 days.

 

8. Prices
All rates are quoted in Euro.
The price mentioned on the product sheets does not include transport costs.
The prices indicated on your order confirmation include the price of the products, the handling, packaging and transport costs of the products.
For products shipped outside the European Economic Community, prices are invoiced exclusive of taxes. In this case, customs duties and other taxes are not the responsibility of TRI S.A. Green Spirit Hotels.

 

9. Payment
All orders, whatever their origin, are payable in Euro.
The price charged is the one indicated on your confirmation of order. The price of the products is payable on the day of the actual order.
Payment is made:

1 - Online by credit card: using the secure payment system Paypal, used by TRI S.A. Green Spirit Hotels.

With secure payment, transaction security is handled on the entire Internet channel: bank, merchant, SSL encryption and server security. We have chosen one of the most reliable secure systems available on the Internet, which protects and encrypts all your personal information.

In the case of payment by bank transfer, the order will be prepared and sent after reception of payment.

10. Litigation
This contract is subject to Luxembourg law.
TRI S.A. Green Spirit Hotels cannot be held liable for damages of any kind, whether tangible or intangible or physical, which could result from a malfunction or misuse of the marketed products.
The same applies to any changes in the products resulting from the manufacturers.
The responsibility of TRI S.A. Green Spirit Hotels will in any case be limited to the amount of the order and cannot be called into question for simple errors or omissions which could have survived despite all the precautions taken in the presentation of the products

Claims or disputes will always be received with kindness, good faith always being presumed in the person who makes the effort to expose his problem. In the event of a dispute, the client will first turn to TRI S.A. Green Spirit Hotels for an amicable solution. It is recalled that the search for the amicable solution does not interrupt the short period of the legal guarantee nor the duration of the contractual guarantee. As a general rule and subject to the assessment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee implies:

• The buyer honours his financial obligations to the seller
• The buyer uses the purchased items in a normal manner.

In the absence of an amicable solution, the Commercial Court of Luxembourg shall have sole jurisdiction, irrespective of the place of delivery and the accepted method of payment.

11. Warranty
In any case, you benefit from the legal guarantee concerning hidden defects (Article 1625 and following of the Civil Code). Provided that you have proved the hidden defect, TRI S.A. Green Spirit Hotels must legally repair all consequences (art. 1641 et seq. Of the Civil Code); if you are going to court, you must do so within a short period of time after discovering the hidden defect (article 1648 of the Civil Code).

12. Intellectual Property
All texts, comments, books, logos and images presented on the TRI S.A. Green Spirit Hotels website are reserved for worldwide copyright and intellectual property rights. Any total or partial reproduction of the TRI S.A. Green Spirit Hotels catalogue is prohibited.

13. Data Protection
Preserving your privacy is very important. For this reason, TRI S.A. Green Spirit undertakes never to communicate your details to third parties. The information you give us will therefore remain confidential.
TRI S.A. Green Spirit uses the technique of cookies, the information thus collected facilitates the use of the site, avoiding you in particular to carry out multiple re-entry. They also allow us to better know your purchasing habits in order to better serve you.
- Your address is useful to us at the time of the order to send your invoice and your order on time.
- Your telephone contact information allows TRI S.A. Green Spirit delivery personnel and customer service to contact you to track your order.
- Your email address allows us to confirm your order, and to contact you if necessary.

Warning
Unfortunately, we are forced to protect ourselves against possible indecent behaviour. To this end, we have put in place the following measures:
• During transactions, we record your IP address, as well as the exact dates and times of transactions. This unique and formal identification confirms your contractual commitment.
• Any attempt at fraud, regardless of the amount or origin, will be subject to criminal prosecution. In this case, all the data collected about you will then be forwarded to the Prosecutor for investigation.
